How to fill out the custody portion of the disclosure forms?


Problem

The second step in the middle of filing for divorce includes revealing all your financial information. This includes things like property and income. It is also the stage where custody and support can be discussed. You may come to an initial agreement but now things have changed. For instance there may now be a child protective service case as your ex spouse has been accused of hitting a child. Should I still turn in my forms with joint custody or will that negatively affect me somehow?


Answer:

The disclosure forms are for property and financials. Property issues are decided separately from any custody issues. In order to establish custody, you should file a request for order to have the court make custody orders that take into account any possible abuse, these forms can be filed AT ANY TIME during the process, in fact the sooner you file the better.
